In a tech powered world, common with financial transactions that cut across international borders effortlessly, tax evasion is rampant across the globe, plaguing governments indiscriminately.
The Organization for Economic Co-operation and Development (OECD) and the Council of Europe perceived the need to streamline certain protocols for the curbing of the tax evasion menace and as such, a multilateral instrument to facilitate the exchange of information between tax authorities was conceived, and in 1988, the Convention of Mutual Administrative Assistance in Tax Matters was adopted in Europe to combat tax evasion and ensure that individuals and businesses pay their fair share of taxes.
Today, many countries have turned to the Mutual Administrative Assistance Convention in Tax Matters to fill the gaps that provide room for tax evasion. This Convention plays a pivotal role in fostering global tax transparency and cooperation and since has undergone various updates and amendments to address the evolving global tax challenges and operate on a worldwide scale.
Join me as we delve into the purpose and significance of the Convention of which our very own Uganda is a signatory of the Multilateral Convention on Mutual Administrative Assistance in Tax Matters (the Convention) and has taken steps to implement its provisions such as enacting the Convention on Mutual Administrative Assistance in Tax Matters (Implementation) Act of 2023 that was then assented to by the President on 2nd June 2023 and commenced operation on the 1st July 2023.
Purpose of the Convention on Mutual Administrative Assistance in Tax Matters (Implementation) Act, 2023
The Convention on Mutual Administrative Assistance in Tax Matters (Implementation) Act, 2023 is a new statute intended to ratify the provisions of the Mutual Administrative Assistance Convention in Tax Matters. The purpose is to enhance international cooperation in tax matters by providing a legal framework for the exchange of information, assistance in tax collection, and other forms of administrative cooperation among its signatory countries. The clear purpose is discussed hereunder;
● Information Exchange: One of the fundamental objectives of the Act is to enable the exchange of tax-related information between participating countries. This includes information about taxpayers, bank account details, financial transactions, and any other relevant data that can help tax authorities identify and combat tax evasion. The Enactment of the Act requires Uganda Revenue Authority to be under duty to share information that may be formally required by Applicant or members of the Convention.
● Assistance in Tax Collection: The Convention on Mutual Administrative Assistance In Tax Matters (Implementation) Act 2023 empowers Uganda Revenue Authority to request assistance from its counterparts in other countries in the collection of taxes. This is especially crucial when taxpayers move their assets or income across borders to evade tax obligations. The Act ensures that such actions do not go unchecked.
● Preventing Double Taxation: By facilitating the sharing of information and administrative cooperation, the Act helps prevent double taxation, which occurs when a taxpayer is liable to pay taxes on the same income or assets in more than one country. This not only benefits individuals and businesses but also promotes cross-border investment and economic growth.
● Enhancing Transparency: The Act promotes transparency by requiring countries to maintain accurate records of financial transactions and share them upon request. This transparency deters tax evasion and money laundering activities, making it more difficult for individuals and entities to hide their financial activities offshore.
● Global Tax Compliance: Perhaps the most significant purpose of the Act is to encourage global tax compliance. It creates a level playing field where all taxpayers, regardless of their location or nationality, are expected to adhere to tax laws. This, in turn, bolsters public trust in the tax system and ensures that governments can finance essential public services.
In an era of increasing global economic interdependence, the Convention Mutual Administrative Assistance Convention in Tax Matters(Implementation) Act, 2023, plays a pivotal role in ensuring that the government collects the revenue necessary to provide essential public services and maintain the integrity of their tax systems.
By promoting information exchange, tax collection assistance, and transparency, the Act stands as a testament to international cooperation in the pursuit of fair and equitable taxation worldwide.
As the global tax landscape continues to evolve, the Convention on Mutual Administrative Assistance Convention in Tax Matters is a vital instrument in the family of tax authorities, working to create a more just and transparent world of taxation.
